I practice law in the areas of probate litigation and estate planning. For almost twenty years I argued probate cases before judges who ultimately had to interpret the meaning of probate statutes and a legal document (a trust for instance). Two years ago I quit litigation and devoted my practice to preventative law–that is, I am attempting on behalf of my clients to either prevent probate litigation with carefully drafted documents, resolve probate disputes outside of court with carefully customized probate ADR agreements, or contain litigation in court with the most carefully drafted estate planning documents I can write–documents that judges cannot misinterpret. I recently had one of my documents tested in the Utah Supreme Court, where the Court unanimously (5-0) found that the text was clear and unambiguous on the dispute in issue and overturned the trial court’s decision to the contrary. A frustrating case in that I thought my writing was clear enough for the trial court to understand.

Then I read yesterday’s WSJ review on Justice Scalia’s and Mr. Garner’s book "Reading Law" (I wish would give reviewers a little more control in utilizing underlining or italics.) I bought a copy last night and have not been able to put it down.

This book is a goldmine for drafters of legal documents. The fundamental, semantic, syntactic, and contextual canons are not only fascinating to read, but are providing eminently practical drafting guidelines that have me intellectually hopping for joy. This book has already taken its place within handreach of my beloved Ninth Edition Black’s Law Dictionary (thank you, Mr. Garner), my Chicago Manual of Style (thanks again for Mr. Garner’s contributions), and my battered twenty-year-old Roget’s Thesaurus.

if you are a college or university student, I say, check out the loose leaf options. I resisted it last year and my shoulders and back paid for it. Get a 2" binder for the book, then get a 1/2" binder for travel. Carry only the chapters you are studying or going to be examed on, leave the rest in the big binder.

Great service. I received the book quickly and got right into my studies. The book itself offers a great basic overview of psychology and is broken up in a way that makes it easy to follow. Take time to read the side notations, the author has a GREAT sense of humor which helps apply some of the concepts. :) Overall, very glad I had the chance to get and work with this book.

I love that this book is presented in modules instead of chapters. It makes it seem like less work to get through each section. The little quizzes are very helpful as well as the notes in the side columns. The author makes the content easy to understand and it’s never boring.

I’m all for Cognitive Therapy, I have done it myself and found huge success in my personal and professional life. I can handle things with so much ease, it’s now second nature. I strongly recommend this book for every parent and every child who is struggling with whatever problem. Cognitive Therapy is for everybody. It’s the answer to a medication free fight against anxiety and depression. I purchased it for a friend of mine but she wasn’t ready for it, my mum also rejected it which was a shame because I know, really know that it would have turned their lives around 180 degrees. My daughter in law took it gladly and she is now reaping the benefits.

This book is well-written, easy to use and easy to understand. It takes you step-by-step through the process of changing your behavior by realizing what is causing the behavior. I have overcome a problem I have been dealing with for more than 15 years by using the principles in this book.

I use this book faithfully with my clientele’ due to how much it is broken down to its most minute concept. The homework assignments in it are so easy to follow and breaks down the various illnesses so well such as depression, anger, anxiety and other ailments that client’s really have that "AHA" moment when doing the homework. If they don’t, they just don ‘t want to.

I have purchased more of the "Dummies" series books and they have helped. Some clients have returned my books in favor of purchIDg their own so they could highlight in them and share informatino with familymembers and other.

Download Winning at Trial 1st Edition

Winning at Trial (Winner of ACLEA’s Highest Award for Professional Excellence) 1st Edition
Author: Visit ‘s D. Shane Read Page ID: 160156001X

Review

Shane Read has written an excellent book that will be most helpful to the bench and bar for many years to come. I wish he had produced this gem 50 years ago so I could have used it when I was a trial lawyer. It would have also made easier my job as a trial judge if the attorneys had the benefit of Winning at Trial when preparing their cases. Shane draws upon his unique experiences as a civil trial lawyer, prosecutor and law professor to set forth in an original and practical way the skills needed to win in the courtroom. —Robert F. Chapman, former U.S. District Judge, retired U.S. Circuit Judge

Shane Read takes a fresh view of the art of persuasion at trial and challenges some of the basic assumptions about what is effective advocacy. Mr. Read s text is a refreshing and thought-provoking analysis that is bound to change the thinking of lawyers and teachers about the art of trial advocacy. The book contains analysis of transcripts of the Timothy McVeigh trial and includes over three hours of video (DVD) of the Simpson trial. —Frederick C. Moss, Assoc. Prof. of Law, Dedman School of Law

Shane Read takes the mystery out of learning trial skills in this unique book, sure to revolutionize the way trial skills are taught. . . . In Winning at Trial, readers study actual trials where techniques are either executed at such a high level of excellence or so badly demonstrated that those skills needed to master winning techniques will never be forgotten. —Eric H. Holder, Jr., former U.S. Deputy Attorney General

About the Author

Shane Read is a graduate of Yale University and the University of Texas School of Law. He began his legal career in 1989 at Akin Gump in Dallas, Texas, before joining the U.S. Attorney’s Office in Washington, D.C. from 1992-1998. Since 1998, he has worked at the U.S. Attorney s Office in Dallas. He has been lead counsel on countless civil and criminal trials over the past eighteen years. In addition, he has served as lead counsel for numerous oral arguments before appellate courts. He has also held a wide variety of teaching positions during his career. He is currently an adjunct professor at Southern Methodist University Dedman School of Law. Here he has taught Trial Advocacy, coached mock trial teams, and currently is teaching a unique seminar on trial strategies. He has also taught both new and experienced lawyers at NITAs seminars on trial skills and at the Department of Justice’s National Advocacy Center.

Paperback: 416 pagesPublisher: LexisNexis / National Institute for Trial Advocacy; 1st edition (June 11, 2007)Language: EnglishISBN-10: 160156001XISBN-13: 978-1601560018 Product Dimensions: 9.7 x 6.9 x 1.2 inches Shipping Weight: 2.2 pounds (View shipping rates and policies) Best Sellers Rank: #171,706 in Books (See Top 100 in Books) #104 in Books > Law > Rules & Procedures > Civil Procedure #29093 in Books > Textbooks #40841 in Books > Reference

I have been a trial lawyer for 18 years and have tried numerous cases to verdict. I like this book so much because it is the first trial advocacy book that contains video of trial skills as seen in a real trial. The book has almost 4 hours of video from the O.J. Simpson trial to compliment the author’s analysis of transcripts of actual trials to teach trial skills. Also, the DVDs are extremely easy to navigate.

So, instead of using hypothetical scenarios to teach lawyers like other textbooks (such as Mauet’s Trial Techniques) which are often unrealistic, the author draws on countless examples from real trials. For example, in Chapter 5, the author teaches how to cross-examine a witness by giving a detailed analysis of a cross-examination used in a civil trial. Then, the author provides study questions for you to consider as you watch six video excerpts from four different attorneys conducting cross-examinations in the Simpson trial. The video clips for cross-examination alone total over 35 minutes. You must read this book before your next trial.

A journeyman knows the mechanics of his trade where a master craftsman knows not only the mechanics, but the theory behind his trade. It is easy to see that the author of this work is a master craftsman as well as a master teacher.

"Winning at Trial" gives clear, concise guidance on how to navigate the turbulent waters of a trial without running aground. Mr. Read teaches not only the basics, but also the nuances of courtroom performance, and does so with concrete, real-world examples from actual cases. The information is presented within the National Institute for Trial Advocacy’s model for trial advocacy, and that model is an excellent one.

I particularly liked Mr. Read’s handling of cross examination. His description of the objectives of cross examination was very good, his instruction on how to impeach by prior inconsistent statement was sound, and he gave an excellent analysis of when and how to ask the ultimate question.

I am a third year law student whose team has won a Regional Mock Trial Championship and competed in a National Competition. I have read several books on trial techniques that have proven to be disappointing. Winning at Trial is an excellent and practical guide written by an experienced and insightful trial attorney. In a clear and straightforward manner, Shane Read takes you through each major stage of the trial and provides helpful examples and spot-on analysis. Not only does Winning at Trial concisely instruct an attorney on how to litigate a case, it teaches how to win as well.

I have only read the first 3 chapters of this textbook and it is so riddled with typographical errors that I can’t even concentrate on what I’m reading.

I paid $115 for this textbook and am very disappointed that I have to use such a poor resource for my course.

Never have I seen a Psychology text book with so many obvious typographical errors. They should have stuck with the 12th edition or taken more time to proofread it.

Bought what was supposed to have been the 13th edition of this book for $64.00, but instead got the 12th edition, which I cannot sell back. Thanks for screwing me out of a lot of money.

Repetition of the same old questions, misleading the buyer and totally unjustified higher cost.

Recommendation: Buy the oldest edition which is as good as the latest.

Great fact patterns that clearly show you where to expect tricks and decoys that will make you trip even when you knew perfectly the theory required by the question. The answers are clear and they elaborate not only on the correct answer but also in showing why the other answers were incorrect, while explaining concepts in a brief but rather complete way.

This is the closest that I have found that is like the MBE questions. Need to prepare for the bar this is definitely something you need. Need some help with those multiple choice questions in law school? This is the book for you.
